La Spezia Forum

In case of dispute, the competent forum is La Spezia. But first we try to solve with a call.

01 Identity of the seller

Len Service S.R.L. — Via Aurelia Sud S.N.C., 19021 Arcola (SP), Italy. VAT: IT 01483520118. PEC: lenservicesrl@pec.it. Email: ecommerce@len-srl.com. Len Service S.R.L. is the owner of the contract of sale and the only person responsible for the bonds resulting from it.

02 Subject of the contract

These General Terms and Conditions of Sale govern only the remote sale of packaging products and related materials through the len-srl.com website. By placing an order, the customer fully accepts these conditions, which prevail over any other agreement not expressly confirmed in writing by Len Service S.R.L.

03 Prices and VAT

All prices are expressed in euro and are VAT excluded, unless otherwise indicated. The 22% VAT will be applied during checkout and invoiced according to the law rate. The published prices are binding at the time of order confirmation and may vary without notice for orders not yet confirmed.

04 Payment methods

We accept: credit and debit card (Visa, Mastercard, American Express), advance bank transfer, PayPal. Business customers with VAT may require deferred payment conditions after written commercial agreement. The order is processed after confirmation of the payment or, for customers with agreed trust, at the time of confirmation of the order.

05 Shipping and delivery

Orders received within 14:00 hours on working days are prepared and entrusted to the courier within 24 hours. Estimated delivery times are: 24–48 hours for Italian territory, 48–72 hours for European countries. Len Service S.R.L. is not responsible for delays attributable to the courier, due to force majeure, to strikes, adverse weather conditions or inaccurate or incomplete delivery addresses provided by the customer.

06 Retreat at home

You can withdraw your order directly at our headquarters in Arcola (SP). The withdrawal is usually available within the working day following the order confirmation; in most cases it is possible already in the day or even within 30 minutes from the confirmation. We ask you to monitor the status of your withdrawal from the "My retreats" section in the customer area (My Account). Please contact us by phone to the number indicated on the Contacts page.

07 Right of withdrawal

Private consumers have the right to withdraw from the contract within 14 days of receiving the goods, without the need to provide any motivation (art. 52 D.Lgs. 206/2005). To exercise the right of withdrawal, simply send a written notice to ecommerce@len-srl.com before the deadline expires. Customised products, tailored or made on specific customer indications are excluded from the right of withdrawal. The right of withdrawal does not apply to business customers (purchase with VAT).

08 Resis and refunds

In case of cancellation or defective product, the refund will be paid within 5 working days of receipt of the goods made, through the same payment method used for the purchase. The delivery costs of the return are borne by the customer in case of withdrawal for rethinking; they are borne by Len Service S.R.L. in case of error or defect of the product. 09 Legal compliance guarantee

All products sold are covered by the legal guarantee of conformity provided by artt. 128–135 D.Lgs. 206/2005 (24 months for consumers, 12 months for business customers). The lack of conformity must be reported within 2 months of discovery, sending email to ecommerce@len-srl.com with order number, description of the problem and product photos.

10 Limitation of liability

Len Service S.R.L. does not respond for: improper use of the products by the customer; incorrect choice of the material not reported before the purchase; indirect damage, loss of profit or consequential damage not foreseeable at the time of the contract. The maximum liability of Len Service S.R.L. is in any case limited to the value of the order concerned.

11 Changes to conditions

Len Service S.R.L. reserves the right to change these General Conditions at any time. The changes shall enter into force from the date of publication on the site and shall apply exclusively to orders made subsequently. For orders already confirmed, the conditions in force remain valid at the time of purchase.

12 Applicable law and jurisdiction

This contract is governed by Italian law. For disputes with consumers (B2C) the forum of the place of residence of the consumer, pursuant to art. 33 Legislative Decree. 206/2005. For disputes with business customers (B2B) the La Spezia Forum is exclusively competent. We invite you to contact us before you sign up for legal reasons: a quick and satisfying solution is found in most cases.
